The man accused of breaching his release conditions will remain behind bars for at least one more week.

Jackie Tran, who police say is a known gang member, was arrested earlier this week because of a breach of his release conditions.

He was set free October 21st while awaiting an appeal of his deportation order.

Four days later, police spotted Tran near a restaurant in Kensington while responding to a disturbance call.

Officers didn't recognize him at the time but arrested him on Tuesday because he was supposed be at home under an 8 p.m. curfew.

The hearing into Tran's most recent arrest took so long that it pushed his deportation hearing back to November 20th.

But he will get a chance to argue for his release again during a detention review in seven days.
