It will be a year before a deadly case of hit and run goes to trial, and what will happen to the accused until then is still up in the air. He is currently under house arrest, but has asked for that to be ended until the trial is completed.

Darren Coupal is charged in the crash that killed Linda Davey and critically injured her 15 year old disabled son.

The two were run down April 30th while walking with friends.

The driver fled the scene but a witness tracked the vehicle to a nearby home and called police.

36-year-old Darren Coupal is charged with impaired driving causing death and driving while suspended. He has pleaded not guilty to all charges.

Coupal is out on bail but under house arrest as he waits for his trial. He is allowed to go to work, attend soccer games and go grocery shopping. He is not allowed to drive.

Coupal's lawyer is applying this Friday to have the house arrest lifted given that the trial is a year away, but will not contest the driving ban.

The Crown is seeking to have Coupal's bail revoked.

Coupal's trial will begin July 20, 2009 and is expected to last 10 days.
